Terms of Service

These Terms of Service ("Terms") govern your access to and use of LeadHog (the "Service"), operated by OINK Digital ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. The Service

LeadHog is a hosted platform that enables users to create embeddable forms, collect submissions, and manage submitted data.

Certain features are available only on paid subscription plans.

2. Account Eligibility and Responsibility

You must be at least 18 years old to use LeadHog.

You are responsible for:

• Maintaining the security of your account credentials
• All activity occurring under your account
• Ensuring information you provide is accurate and current

You may delete your account at any time through the Service.

3. QuickPages Account Provisioning

LeadHog accounts may be created on a user's behalf as part of an integrated service offering with QuickPages.

If your LeadHog account was created through QuickPages:

• The account was provisioned with your authorisation as part of the QuickPages service
• Access credentials and account control are provided to you
• Your use of LeadHog remains subject to these Terms

By using a LeadHog account created via QuickPages, you acknowledge that:

• The account was created to provide form handling services
• Certain configuration or setup steps may be completed on your behalf
• Responsibility for ongoing use of the account rests with you

4. User Content and Data Ownership

You retain full ownership of all data collected through your forms, including form submissions and user-provided content.

You are solely responsible for:

• The content of your forms
• Where and how your forms are embedded
• Compliance with all applicable privacy and data protection laws

LeadHog does not determine what data you collect.

5. End Users of Embedded Forms

Individuals submitting data via your embedded forms ("End Users") do not have a direct relationship with LeadHog.

You acknowledge that:

• End Users may not know LeadHog is used to process their data
• You are responsible for providing appropriate disclosures and privacy notices
• You are responsible for obtaining any required consent

LeadHog acts only as a technical service provider for this data.

6. Optional AI Processing Features

LeadHog may offer optional features that allow form submission data to be processed using third-party AI services, including OpenAI APIs.

Conditions:

• AI processing is disabled by default
• Users must explicitly enable it
• It is available only on eligible paid plans

You are responsible for:

• Deciding whether AI processing is appropriate
• Informing End Users if their data may be processed by third-party AI services

LeadHog is not responsible for how AI-generated output is used.

7. Usage Limits and Fair Use

Subscription plans may include limits such as:

• Monthly submission counts
• Feature availability

If limits are reached:

• Submissions may continue, but features may be restricted
• No guarantees are made regarding overages or excess capacity

Limits reset according to your billing cycle.

8. Spam and Abuse

LeadHog includes built-in anti-spam measures, including automated protections and honeypot techniques.

You acknowledge that:

• No anti-spam system is fully effective
• Spam submissions count toward usage limits

We reserve the right to:

• Restrict, suspend, or disable accounts experiencing excessive spam or abuse
• Take action to protect system stability and service integrity

LeadHog is not responsible for usage exhaustion caused by spam activity.

9. Payments and Subscriptions

Paid plans are billed via Stripe using Stripe-hosted checkout pages.

• LeadHog does not store payment card details
• Subscriptions renew automatically unless cancelled
• Fees are non-refundable unless required by law

Billing disputes must be raised promptly.

10. Account Suspension and Termination

We may suspend or terminate access to the Service:

• For violations of these Terms
• To comply with legal obligations
• To protect LeadHog, its users, or its infrastructure

You may terminate your account at any time.

11. Service Availability

The Service is provided on an "as-is" and "as-available" basis.

We do not guarantee:

• Continuous availability
• Error-free operation
• Fitness for a particular purpose

12. Limitation of Liability

To the maximum extent permitted by law:

• LeadHog is not liable for indirect, incidental, or consequential damages
• We are not responsible for loss of data, revenue, or business interruption

Your use of the Service is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless OINK Digital from any claims arising from:

• Your use of the Service
• Your forms or collected data
• Your failure to comply with applicable laws

14. Changes to the Terms

We may update these Terms from time to time.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Victoria, Australia.
